Advertising & Partnership Terms and Conditions

These Advertising and Partnership Terms and Conditions apply to advertising, sponsored content and other commercial placements purchased for publication in Childhood Magazine.
By confirming an advertising or commercial partnership booking with Childhood Magazine, the advertiser agrees to these Terms and Conditions.
For the purposes of these Terms, “Childhood Magazine”, “we”, “our” and “us” refer to the publisher of Childhood Magazine. “Advertiser” refers to the business, organization or individual purchasing or supplying advertising or sponsored content.
1. Advertising Rates
All advertising rates are quoted in Australian dollars (AUD).
Prices will be identified as including or excluding GST, as applicable to the publisher at the time of booking.
Rates published in our current media kit are valid at the time of publication and may be changed for future bookings or editions.
Where introductory rates, promotional offers or packages are offered, these may be withdrawn or changed at any time for future bookings.
Once an advertising booking has been accepted and paid, the agreed price for that booking will not be changed.
2. Advertising Bookings
Advertising placements are subject to availability.
Submitting an enquiry does not reserve an advertising position.
A booking is confirmed when:
-
the advertiser has provided the information requested by Childhood Magazine;
-
the booking has been accepted by Childhood Magazine; and
-
payment has been received, unless alternative payment arrangements have been agreed to in writing.
Advertising inventory may be limited for individual editions to maintain an appropriate balance between editorial and commercial content.
We reserve the right to decline a booking before confirmation.
3. Payment
Unless otherwise agreed in writing, payment is required in full prior to the advertising material deadline.
Invoices must be paid by the due date stated on the invoice.
If payment has not been received by the required deadline, Childhood Magazine may release the reserved advertising space to another advertiser.
Publication will not ordinarily proceed where payment remains outstanding.
4. Cancellations
Advertising cancellations must be made in writing.
Where cancellation occurs before the advertising material deadline, Childhood Magazine may, at its discretion, offer a refund, credit or transfer of the booking to another suitable edition.
Once advertising material has been prepared, incorporated into an edition or the relevant material deadline has passed, payments may be non-refundable to the extent permitted by law.
If Childhood Magazine cancels a confirmed advertising placement and cannot offer a reasonably suitable alternative, any amount paid for the affected placement will be refunded.
Nothing in these Terms is intended to exclude rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
5. Advertising Material
Advertisers are responsible for supplying completed advertising material by the specified deadline and according to the technical specifications provided.
Material should be supplied in a professional, publication-ready format and at sufficient resolution for digital publication.
If supplied material does not meet publication requirements, we may request replacement material.
We are not responsible for reduced reproduction quality resulting from low-resolution, incorrectly formatted or otherwise unsuitable material supplied by an advertiser.
Significant design work, copywriting, alteration or preparation requested from Childhood Magazine may incur an additional fee where agreed with the advertiser in advance.
6. Deadlines
Advertising material must be received by the deadline provided for the relevant edition.
Late material may result in:
-
publication using previously approved material;
-
transfer of the booking to a later edition; or
-
omission from the edition.
We will make reasonable efforts to accommodate late material but cannot guarantee inclusion after the deadline.
7. Advertising Content and Claims
Advertisers are responsible for ensuring that their advertisements and supplied content comply with applicable Australian laws, regulations and advertising standards.
All statements, representations, prices, environmental claims, health claims, testimonials, product claims and other information supplied by an advertiser must be accurate and capable of substantiation where required.
Advertisers must not provide material that is misleading, deceptive, defamatory, unlawful or otherwise infringes the rights of another person or organization.
Acceptance of an advertisement by Childhood Magazine does not constitute endorsement or verification of the advertiser's claims.
8. Advertising Relating to Children
Because Childhood Magazine operates within the childhood, family and education space, particular care will be taken with advertising involving or directed towards children.
Advertising must comply with applicable Australian advertising standards and any relevant requirements concerning marketing to children.
We reserve the right to decline products, services, imagery or advertising approaches that we consider inappropriate for our readership or inconsistent with the editorial values of Childhood Magazine.
9. Health, Therapeutic and Nutritional Claims
Advertising involving health, wellbeing, therapeutic products, supplements, nutrition or related services may be subject to additional Australian laws, codes and regulatory requirements.
Advertisers are solely responsible for ensuring that any such advertising is legally permitted and that all claims, disclosures and approvals required for publication have been obtained.
Childhood Magazine may request amendments, supporting information or evidence of regulatory compliance before accepting such advertising.
We reserve the right to decline health-related advertising at our discretion.
10. Sponsored and Partner Content
Sponsored articles, advertorials, paid partnerships and other commercial editorial content will be clearly identified as commercial or sponsored content where appropriate.
Childhood Magazine retains editorial oversight of sponsored content.
Sponsored content must provide appropriate value to our readership and must not be presented in a manner that misleadingly suggests it is independent editorial content.
We may edit sponsored material for spelling, grammar, formatting, length, house style and readability.
Material changes affecting the substance of advertiser-supplied sponsored content will ordinarily be discussed with the advertiser prior to publication.
Payment for sponsored content does not guarantee a positive review, independent editorial endorsement or recommendation by Childhood Magazine.
11. Editorial Independence
Purchase of advertising does not provide an advertiser with control over the independent editorial content of Childhood Magazine.
Advertising relationships do not guarantee editorial coverage, product reviews, recommendations or inclusion in future editions unless these form part of an expressly agreed commercial package.
Similarly, editorial contributors are not required to purchase advertising.
12. Right to Refuse Advertising
Childhood Magazine reserves the right to decline or remove advertising or sponsored material that we reasonably consider:

inconsistent with the publication's audience or values;
-
inappropriate for children, families or educators;
-
misleading or potentially unlawful;
-
discriminatory, offensive or harmful;
-
inconsistent with applicable advertising standards;
-
damaging to the reputation or integrity of the publication; or
-
unsuitable for the theme or editorial direction of an edition.
Where possible, advertisers may be offered an opportunity to amend material that does not meet our requirements.
13. Intellectual Property and Permissions
Advertisers retain ownership of intellectual property in advertising materials supplied by them.
By supplying advertising material, the advertiser grants Childhood Magazine a non-exclusive license to reproduce, display, publish and distribute that material as reasonably required to fulfil the advertising booking and maintain the relevant digital edition.
The advertiser warrants that it owns, licenses or otherwise has permission to use all photographs, illustrations, logos, trademarks, written material and other content supplied for publication.
This includes obtaining appropriate permissions from photographers, designers, models, contributors and other rights holders where required.
Advertisers must not knowingly provide material that infringes another person's intellectual property rights.
14. Images of Children
Where advertising material contains identifiable children, the advertiser is responsible for ensuring that all necessary permissions and consents have been obtained for the intended commercial publication and use of those images.
Childhood Magazine may request confirmation of appropriate consent before publication.
We reserve the right to refuse imagery that we consider inappropriate for the publication.
15. Placement and Design
We will make reasonable efforts to provide the advertising format purchased by the advertiser.
Unless a particular position has been expressly purchased or agreed in writing, specific page numbers, proximity to particular editorial content and exact positioning within an edition are not guaranteed.
Editorial design and final pagination remain at the discretion of Childhood Magazine.
16. Digital Publication and Longevity
Childhood Magazine is an evergreen digital publication.
Our intention is for editions to remain available online for an extended period, and advertising may therefore continue to appear within an edition after its original publication date.
Any stated publication period represents our intended minimum availability rather than a guarantee that an edition will remain online indefinitely.
Editions may subsequently be updated, redesigned, migrated to another platform, archived or withdrawn where reasonably necessary due to technical, editorial, legal or business requirements.
Advertisers acknowledge that websites, digital platforms, URLs and third-party publishing services may change over time.
17. Links and External Websites
Where an advertising package includes a hyperlink, advertisers are responsible for supplying the correct destination URL.
We are not responsible for the operation, availability, security or content of third-party websites linked from Childhood Magazine.
Advertisers should notify us if a published advertising link requires correction.
18. Errors and Corrections
Every reasonable effort will be made to reproduce advertising material accurately.
Advertisers should check proofs where a proof is supplied and promptly advise us of any errors.
Where an error has been introduced by Childhood Magazine and materially affects an advertisement, we will work with the advertiser to provide an appropriate remedy, which may include correcting the digital edition, providing an alternative placement or offering a credit where appropriate.
We are not responsible for errors contained in material supplied or approved by the advertiser.
19. Publication Dates
Any proposed publication date is an estimate unless expressly stated otherwise.
As an independently produced digital publication, release dates may occasionally change due to editorial, production, technical or other circumstances.
Where a significant delay occurs, confirmed advertisers will be informed within a reasonable time.
A change in publication date does not automatically cancel an advertising booking, although we will work reasonably with advertisers where timing was an essential element of a campaign.
20. Complimentary Listings and Promotions
From time to time, Childhood Magazine may offer complimentary business listings, editorial inclusions, promotional opportunities or other benefits.
Complimentary inclusion does not create an entitlement to inclusion in future editions and does not require the recipient to purchase advertising.
Likewise, purchasing advertising does not automatically entitle an advertiser to complimentary editorial coverage or future listings unless expressly included in the purchased package.
21. Contributors
Editorial contributions are separate from paid advertising unless expressly agreed otherwise.
Submission or invitation to contribute does not guarantee publication.
Childhood Magazine may edit accepted contributions for grammar, spelling, length, formatting and house style while taking reasonable care to preserve the contributor's intended meaning.
Contributors must disclose relevant commercial relationships, sponsorships or conflicts of interest associated with submitted material.
Contributors are responsible for ensuring that material they submit is their own work or that they have permission to reproduce any third-party material included in their submission.
Separate contributor guidelines or agreements may apply to commissioned or substantial editorial contributions.
22. Privacy
Information supplied during advertising enquiries and bookings will be used for purposes reasonably connected with managing the advertiser relationship, including communication, invoicing, publication and administration.
Personal information will be handled in accordance with applicable Australian privacy requirements and our Privacy Policy, where applicable.
Marketing communications will be managed separately from communications reasonably necessary to administer an existing advertising or contributor relationship.
23. Liability
To the maximum extent permitted by law, Childhood Magazine is not responsible for indirect or consequential loss arising from an advertisement, publication delay, technical interruption, third-party platform failure or external website.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian law.
24. Changes to These Terms
These Terms may be updated periodically.
The terms applicable to an advertising booking will ordinarily be those provided or made available when that booking is confirmed, unless a change is required by law or otherwise agreed between the parties.
25. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
The parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.
